IMMIGRANT WORKER PROTECTION ACT – UPDATE

This is an update to the story we brought you last week regarding the new Immigrant Worker Protection Act.  California Attorney General Xavier Becerra has stated his office will go after companies that are coordinating with federal authorities. Click here to read the article.

On January 1, 2018, the new Immigrant Worker Protection Act (AB 450), became effective. The law is designed to protect an estimated three million plus undocumented Californian employees, of whom over half are active in the workforce, from Federal immigration enforcement through workplace raids.  The law prohibits employers from providing federal immigration enforcement agents access to a business without a warrant and requires employers to notify employees of Form I-9 inspections performed by federal immigration enforcement officials (AB 450).

It is very important that you as an employer know your responsibilities under this law and we recommend you with your Human Resources professionals and company attorneys to plan and assure you are in strict compliance with the law.
