HAPPY FOURTH OF JULY

Posted: July 22, 2015 | Posted by Crystal Whitfield | No Comments
What started out as a celebration to mark our young nation’s independence from England more than 200 years ago, has evolved into a national holiday that celebrates the American spirit and our nation’s independent and powerful leadership in the world. Our nation was founded by recognizing a person’s inherent rights and responsibilities. We were founded on the principles of equality, religious tolerance, and opportunity. These beliefs have been challenged many times over the years, but have always ...

CHANGE OF OWNERSHIP BILL INTRODUCED

SB 259 (Bates), a bill similar to an effort supported by industry last year to address egregious has been introduced by Senator Pat Bates (R-Laguna Niguel) and seeks to modernize the “change of ownership” definition under Proposition 13. Last year, BOMA California along with the CalChamber and several other business groups, worked with the Chair of the Assembly Revenue & Taxation Committee Raul Bocanegra (D-Pacoima) to negotiate a potentially historic agreement to fix this issue, which anti-Prop ...

FLASHBACK:  The drama that occurred last year on this Change of Ownership Deal was incredible and should be remembered, in hopes that we can avoid a similar meltdown this year.  We hope that advocates that have been pushing “to close the loophole” can work with us this year to do just that.  Here, we are re-printing the story from last year… (This was originally printed June 26, 2014) — In a surprise move, the Lenny Goldberg, who represents the California Tax Reform Association, and ...

SPLIT ROLL PROPERTY TAX

Posted: July 22, 2015 | Posted by Crystal Whitfield | No Comments
There has been a lot of activity on Split Roll Property Tax in the past few weeks.  The proponents of removing Proposition 13 protections from commercial property have opened up several paths of attack, including an effort to gather signatures for a proposition, introducing a bill in the legislature (SCA 5), a full-on media effort, and requesting that local city councils and school board endorse these efforts. Many of our members are worried – rightly so – and have asked what they can do the ...

WATER ISSUES – GET INVOLVED LOCALLY

Posted: July 22, 2015 | Posted by Crystal Whitfield | No Comments
Commercial property owners are encouraged to reach out to their local water district contacts and request a copy of the district’s drought ordinance or water conservation plan.  These are the two most common names for the documents created by local water districts, which spell out in detail how they will respond with water service in a declared drought. In many cases, these documents predate the current crisis, as declared by Governor Brown, but have been “dusted-off” and updated as the controlling ...

DEFIBRILLATOR BILLS UPDATE

Posted: July 22, 2015 | Posted by Crystal Whitfield | No Comments
Here is an update on where we stand with two bills relating to on Automatic External Defibrillator (AED) policy.  Early in the session two bills were introduced, one of which we immediately supported SB 658 (Hill; D-San Mateo) and one which caused some concern SB 287 (Hueso; D-San Diego). Because of the life-saving potential of AEDs and their proven efficacy, our industry has been working to increase accessibility of these devices in public places where cardiac arrest may be a significant risk.  ...

BILL MANDATES LEASE LANGUAGE FOR BUILDING CODE

Posted: July 22, 2015 | Posted by Crystal Whitfield | No Comments
A bill that was recently gut-and-amended would require commercial leases to have provisions in them that allow a tenant to withhold rent, if the leased building is not fully compliant with provisions of a bill from 2009 (SB 407 – see below for more information) that requires that building built prior to 1994 upgrade water fixtures, including toilets. AB 723 (Rendon; D-Lakewood) seeks to give tenants building code enforcement authority through lease provisions if water fixtures in the leased building ...
